  U.S Business Product Claims

Opportunity Specific Claims

  • Eliminate use of the term "business opportunity" completely, which is a regulated form of business that is not to be confused with direct selling.
  • Use "income opportunity," "financial opportunity," or "home-based opportunity."
  • When discussing the MonaVie opportunity, you must mention that the purchase of tools is optional.
  • The word FREE should never be used to describe MonaVie products - regardless of how they're obtained. Also, the word FREE should never be used to describe rewards obtained through the comp. plan.
  • Any time you make any type of income claim or lifestyle claim, you must present an IDS. claims.

AUTOSHIP

  • Position Autoship as a great way to ensure you never run out of product to service your customers, to share with prospects and to personally consume.
  • Do not position the Autoship as a way to remain active or qualify for compensation.
  • Example: “Neither a product order nor participation in the Auto-Ship program are required to become a distributor, activate, or remain active. Both are optional".
  • You MUST indicate that Auto-Ship is optional for becoming a distributor AND for earning compensation:

PURCHASING REQUIREMENTS

  • Do not impose personal purchase requirements, as they violate state anti-pyramid laws.
  • Do not require a distributor to purchase a minimum amount of product.
  • You may say that a distributor must generate a certain amount of personal volume to qualify for earnings under the compensation plan.

INCOME CLAIMS

  • Any reference to or discussion about earnings and/or lifestyle must be accompanied with a copy of the Income Disclosure Statement (IDS) that the Distributor can either hold or see (if projected or placed in at the front of the audience). If in an AV format, include a line stating: "Please see the MonaVie Income Disclosure Statement at the end of this CD/DVD or at www.MonaVie.com for complete information regarding the earnings of MonaVie distributors."
  • Use non-financial phrases like "Beyond Imagination" or "Your Wildest Dreams."
  • Use terms like "income-creating" rather than "wealth-creating"

COMP PLAN

  • Any income presentations (person or paper) must include a line stating: "Please see the MonaVie Income Disclosure Statement at the end of this document or at www.MonaVie.com for complete information regarding the earnings of MonaVie distributors."
  • PV is "generated" not "purchased."
  • Use wording like "Build teams that duplicate by helping your personally sponsored distributors build their businesses and you will earn a $40 Star Makers Bonus"
  • Regarding Rank Advancements, either is acceptable:

    i. To qualify for the following ranks one must be active with 100 or more of personally-generated points during the qualifying week . . .

ii. Be active with 100 or more personally-generated points during the qualifying week.

  • Avoid the words "investment" or "invest". It's OK to talk about investing time or effort -- but not money. Accordingly, use words like "cost" or "expenditure" to describe the Starter Kit.
